Call to remove abortion from Crimes Act . A major welfare group has called on the NSW government to decriminalise abortion to ensure women and doctors can't be prosecuted.

Alison Peter, director of the NSW Council of Social Service, is urging the state to follow the lead of the ACT and Victoria and remove abortion from the Crimes Act.

The Act states that anyone who unlawfully commits an act with the intention of procuring a miscarriage is liable to 10 years imprisonment.

"Abortion continues to be a crime under the NSW Crimes Act and women who undergo an abortion and their doctors are potentially at risk of prosecution," Ms Peter said in a statement on Friday.

The last time a doctor in NSW was convicted for carrying out an illegal abortion was in 2006.

Ms Peters countered claims that legalising abortion would increase the number of medical procedures carried out.

"There is no evidence to support this," she said.

"For six months prior to and after the removal of abortion from the Victorian Crimes Act, the number of abortions claimed under Medicare in Victoria and Tasmania increased by less than one per cent."

The NSW Greens have been campaigning for the decriminalisation of abortion this year, citing a poll which found broad support for such a move.

Published in the Medical Journal of Australia, the poll indicated a clear majority of Australians believe abortion should be lawful without question in a woman's first trimester, or lawful depending on her circumstances in the second trimester.

living at today :Working to make bullying a crime


CNN-In Today's Living, a father on a mission, to make sure a tragedy that struck his family, will not happen to yours. Kirk Smalley says his son lost his life to a bully.

Smalley is on a mission. There he is, an honored guest, at Oklahoma City's Western Heights High School trying to put a stop to bullying. He says, "I have to make a difference. I promised my son on Father's Day this year I'd stop this from happening to another child."

For years Smalley's son, Ty, struggled with a bully at school. When asked, "When you say he was being picked on, how was he being picked on?" Smalley replied, "Name-calling. Ty was always pretty small for his age, and he'd get shoved, pushed here and there."

His father says he was a typical kid with typical grades who took the abuse for two years. On the day Ty finally decided to push back physically he got into trouble. He was suspended from school. For Ty, it was too much to bear.

On that day, last May, he killed himself. He was 11 years old.

Smalley says, "Ultimately my son's safety rested in my hands. I was responsible for my son's safety. That's a harsh thing to say about yourself. I'm his dad, it's my job to protect him. No matter what. No matter where he was, it's my job to protect him."

But, how do you protect your child from a bully? Assistant Deputy Education Secretary Kevin Jennings was appointed by President Obama to keep kids safe at school. Ty's story could easily have been his own. Jennings says, "Like many kids I was bullied very severely when I as in junior high and high school. And the first day of 10th grade I actually refused to go back to school because I simply wasn't going to go back to a place where I was bullied every day."

Jennings organized the nation's first-ever bullying summit. But, even he admits it's a baby step.

Experts can't even agree on how to define bullying. Is it physical? Electronic? Psychological? Non-verbal? Or all of the above? Jennings says, "When might something happen? When might the federal government act and say theses are the guidelines we want to put in place, do it. It's taken us a long time to develop a bullying problem. It's going to take us some time to solve it."

There are no federal guidelines schools must follow to deal with bullying. Each school or district develops its own policies. But, Smalley is working to make bullying a crime.

Surveillance shows Kendrick Morris near crime scene

Tampa, Florida - The young victim suffered a broken nose, a fractured skull, dead brain cells, blindness, loss of muscle control and loss of ability to speak.

She can no longer eat, walk or stand.

This is the damage that the victim in the Bloomingdale Library rape trial endured after she was attacked, according to Neurosurgeon Dr. Siveiro Agazzi.

On day five of the Bloomingdale trial, Dr. Agazzi gave specific details as to the victim's condition. "She is in a persistent vegetative state," he said.

When asked if the injuries will last a lifetime, he replied, "Yes, they are permanent."

The young woman, who was a high school senior at the time of the attack, had already been accepted to the University of Florida. She can hear people, but has a hard time responding.

She grunts to communicate, but is unable to formulate words.

The victim doesn't even remember what happened. She has no recollection of that night.

Prosecutors continued their case Friday as they introduced video showing Morris at a nearby McDonald's less than an hour after detectives say he raped the East Bay High School student when she tried to return books at the library on April 24, 2008.

The McDonald's was less than a mile from the library.

In the video, Morris is seen inside the fast food restaurant surrounded by large yellow balloons with happy faces on them. Detectives say he walked in at 11:09 p.m. in a hoodie and jeans and ordered two big Value meals before sitting down to eat.

He left at 11:28 p.m.

Shortly after, Morris is then seen in a Wal-Mart where he walks in and proceeds to walk up and down the aisles.

Detective Gary Harris, a 20-year-veteran of the Hillsborough Sheriff's Office, testified that the young man on video was, in fact, Morris. "He enters the store, the clothing matches and you can see it's Kendrick Morris," the detective testified.

The defense claims, however, that the time stamp on the Wal-Mart video says 10:22 p.m. - right around the time that the young woman was attacked at the library.

The actual attack, deputies say, took place at 10:15 p.m. that night.

Morris' attorneys claim that there's no way their client could be at the library and Wal-Mart at the same time. However, prosecutors called a Wal-Mart loss prevention specialist to testify. The man claimed that during power surges, the clock on the video resets, advancing more than an hour, which changes the time stamp on the video. It is similar, he explained, to an alarm clock that goes off during a storm.

Roberto Soto said, "Whenever I'm asked to look at video, I look at my watch and systems to match what I'm looking for."

Defense attorneys also cross-examined both Detective Harris and his colleague, Detective Geoffrey Harris. The attorneys hammered away at the men trying to prove that they were not thorough enough in their investigation and were off in documenting time notations in their reports.

Defense Attorney Rocky Broncato continually asked Detective Geoffrey Harris about the approximations of times that were listed on the application for a search warrant where Morris entered the McDonald's and Wal-Mart.

Broncato said that the times were off by a few minutes, saying, "Why did you say that? You realize you were under oath?"

The defense has maintained all along that the evidence in the case was contaminated and that the Sheriff's Office detectives were inaccurate.

Prosecutors continued to try and bolster their case by calling the manager of United Cabs to testify. The woman took the stand and said that Morris ordered a cab to pick him up a the Wal-Mart after the crime took place.

Jean Torres said, "Well, yeah, they give their name."

Prosecutors asked, "Okay, and in this case, it was Kendrick?"

Torres answered, "That's what it says on the order, yes."

The article was severely lacking in verifiable data and was poorly researched. The Times Herald would be well aware that there is no connection between the recent violent crimes on Griswold and the social service programs in south Port Huron.

After all, the Times Herald itself has reported that the June 17 shooting was related to a prior dispute between the perpetrator (from Detroit) and his victim, and that the machete attack (also involving an out-of-town perpetrator) occurred at 4:15 a.m. -- a time when all programs were long closed.

I note that Port of Hopes, a social support program for people with mental illness is mentioned more than a dozen times. This center has been providing services for more than 15 years without a problem, so why is it now targeted?

Perhaps Councilman Jim Fisher has provided the answer: It's the condos! Councilman Fisher states, "It would help the sale of the condos if the Port of Hopes were elsewhere." So who owns a financial interest in the condos? Is there a conflict of interest here?

Regarding the social service programs, mayor pro tem Steve Miller states, "If it was in my neighborhood I don't know if I would want it." He is clearly an adherent of NIMBY (not in my backyard). Is this the philosophy that is going to guide future council decisions?

Each of the social service programs listed in the article provides a much needed support to area residents, particularly in today's economy. The Times Herald has done a disservice to its readers in misrepresenting the facts of this issue.
